1. This Promotion is open to legal residents of the 50 states of the United States of America & District of Columbia (“USA”), Australia (“AUS”), Canada (“CA”), Germany (“DE”), India (“IN”), the Republic of Ireland (“ROI”), Peru (“PE”) and Sweden (“SE”) who are at least 18 years of age or the age of majority in their respective jurisdictions of residence, whichever is older. Employees, officers and directors of the Sponsor, Administrator and their agents, administrators and creative entities, and anyone professionally associated with this Promotion, and anyone residing in the household of any of the foregoing (whether related or not) are not eligible to enter or win.  

2. NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER, WIN, OR CLAIM A PRIZE FOR RESIDENTS FROM THE USA, CA OR IN; A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Residents of CA will be required to correctly answer a timed four-part maths question before being confirmed a winner.  

3. A purchase is necessary in order to enter the Promotion for residents of AUS, DE, the ROI, PE and SE. Residents of the ROI will also be required to correctly answer a skill-based question to enter.

4. Internet access and a valid email address are required for all entrants. 

5. Promotion Period: Enter between 00:00AM Central European Summer Time (“CEST”)/ 08:00AM Australian Eastern Standard Time (“AEST”) on 19 May, 2025 and 11:59PM CEST on 27 July, 2025 (7:59AM AEST on 28 July, 2025) inclusive (the “Promotion Period”).

6. To Enter: During the Promotion Period, entrants may enter using one of the designated entry options below, depending on the entrant’s jurisdiction of residence at the time of entry. By entering, you will be deemed to have agreed to be bound by these Official Rules.

a. Purchase Entry Method: Purchase an Optimum Nutrition product from a Participating Retailer (see Clause 7 for a full list) during the Promotion Period. Then, visit www.promoentries.com/win-with-optimum-nutrition-2025 navigate to the country specific page, complete the online form to provide your full name, email address, your Optimum Nutrition order number, your correct answer to a skills based question (ROI residents only) and upload a photo of your receipt. Upon completion and submission of the online form, each entrant will be entered with one (1) entry into the Promotion. 

b. Free Online Entry Method [USA, CA and IN residents only]: To enter without making a purchase, residents of USA, CA and IN may visit www.promoentries.com/win-with-optimum-nutrition-2025 and complete the online form to provide their full name, email address. Upon completion and submission of the entry form, each entrant will automatically be entered with one (1) entry into the Promotion.

LIMIT ONE ENTRY PER PERSON, PER ORDER NUMBER OR UNIQUE RECEIPT (WHERE REQUIRED), PER DAY THROUGHOUT THE PROMOTION PERIOD, REGARDLESS OF METHOD OF ENTRY USED OR NUMBER OF PRODUCTS PURCHASED. Normal Internet access, phone, and usage charges imposed by your online or phone service may apply. If you are entering via a mobile device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. Automated entries, entries which use or in any way incorporate artificial intelligence or any other simulation of human intelligence or process through the use of a machine or computer system (collectively, “Artificial Intelligence”), either in the creation or submission of the entry or as a part of any entry, and/or third-party entries are prohibited. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses or any other method will void all of that entrant’s entries, and that entrant may be disqualified at Sponsor’s discretion. Normal Internet, phone and usage charges imposed by your online or phone service may apply. Incomplete, illegible, corrupted or untimely entries are void and will be disqualified. Sponsor and its agencies are not responsible for (i) acts of entrants or third parties that lead to lost, late, incomplete, damaged, stolen, misdirected or illegible entries; (ii)  lost, interrupted or unavailable network, server or other connections; or (iii) miscommunications, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a user’s computer equipment (software or hardware) or other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant or participant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider or other organization (which may include an employer) responsible for assigning email addresses for the domain associated with the submitted address. Provisional winner may be required to show proof of being the authorized account holder. Entries specifying an invalid, non-working or inactive email address will be disqualified and ineligible to win.

1. Participating Retailers:  For those entrants entering via the purchase entry method, purchases from the following Online and In-Store Retailers are eligible for participation in this Promotion:

 

1. Odds of Winning: Your odds of winning depend on the total number of eligible entries received.

2. The Prizes: There will be a total of one hundred and sixty-three (163) winners, each winning one (1) Prize. Prizes will be randomly allocated, with the winner of the Tier 1 Prize being drawn first, followed by the two (2) winners of the Tier 2 Prize, the ten (10) winners of the Tier 3 Prize and so on. No person may win more than one (1) Prize.

a. Tier 1 Prize: There will be one (1) Tier 1 winner. The Tier 1 winner will win one (1) Pirelli Hot Lap Experience in Abu Dhabi between 4 December 2025 and 8 December 2025 (details below).  Approximate retail value (“ARV”) of the Tier 1 Prize is £19,972 / USD$25,764 / AUD$42,840 / €23,467. The Prize includes:

i. Round trip economy flights for winner and one (1) guest from the winner’s closest international airport to Abu Dhabi. The outbound flight will arrive on 4 December 2025 & inbound flight will depart on 8 December 2025;

ii. Four (4) nights’ accommodation (one (1) room, double occupancy, 4-star hotel) for the winner and one (1) guest in Abu Dhabi, for the following nights: 4 December, 5 December, 6 December and 7 December 2025;

iii. Round trip transfers from the airport to the hotel;

iv. Two (2) 3-Day grandstand tickets for winner and one (1) guest for the Abu Dhabi Grand Prix, which will take place between 5 December and 7 December 2025 inclusive;

v. Paddock Club access for winner and one (1) guest for 5 December 2025 (practice day); and

vi. One (1) Hot Lap experience for either the winner or winner’s guest (together, the “Tier 1 Prize”).

b. Tier 2 Prize:  There will be two (2) Tier 2 winners. Each Tier 2 winner will win one (1) driver glove bundle. Approximate retail value (“ARV”) of each Tier 2 Prize is £400 / USD$516 / AUD$858 / €470. The bundle includes:

i. One (1) pair of gloves signed and race worn by one of the McLaren Racing drivers; and

ii. One (1) Optimum Nutrition Voucher equivalent to £200 / USD$258 / AUD$429 / €235 (together, the “Tier 2 Prize”).

c. Tier 3 Prize: There will be ten (10) Tier 3 winners. Each Tier 3 winner will win one (1) signed replica bundle. Approximate retail value (“ARV”) of each Tier 3 Prize is £230 / USD$297 / AUD$493 / €270. The bundle includes:

i. One (1) replica McLaren Racing team shirt signed by the McLaren Racing drivers; and

ii. One (1) Optimum Nutrition Voucher equivalent to £150 / USD$194 / AUD$322 / €176 (together, the “Tier 3 Prize”).

d. Tier 4 Prize: There will be fifty (50) Tier 4 winners. Each Tier 4 winner will win one (1) McLaren Racing x Optimum Nutrition merchandise bundle. Approximate retail value (“ARV”) of each Tier 4 Prize is £220 / USD$284 / AUD$472 / €258. The bundle includes:

 i. One (1) Co-branded McLaren Racing Cap;

ii. One (1) Co-Branded Thermal Water Bottle; and

iii. One (1) Optimum Nutrition Voucher equivalent to £100 / USD$129 / AUD$215 / €117 (together, the “Tier 4 Prize”).

e. Tier 5 Prize: There will be one hundred (100) Tier 5 winners. Each Tier 5 winner will win one (1) Optimum Nutrition voucher equivalent to £50 / USD$65 / AUD$107 / €59. Approximate retail value (“ARV”) of each Tier 5 Prize is £50 / USD$65 / AUD$107 / €59.

1. Further Prize Details:

a. Tier 1:

i. All tickets and access where relevant are valid for the dates specified within these Official Rules.  Should the winner be unable to attend any of the specified dates, no alternative dates will be provided.

ii. Race dates are subject to change at the discretion of Formula One. The winner will not be entitled to any compensation and will have no claim against the Sponsor, Administrator or Formula One if the race associated with their Prize or any other element-forming part of the Prize is delayed, postponed, rescheduled or cancelled (for any reason whatsoever).

iii. The guest of the winner must be 18 years of age or older and the age of majority in their jurisdiction of residence at the time of travel.

iv. For the avoidance of doubt, the Prize does not include food, beverages, souvenirs, gratuities, excess baggage, additional excursions and attractions or any other costs of a personal nature (including spending money) that are not explicitly set out in these Official Rules and neither the Sponsor nor any provider of any part of the Prize will be responsible for any such costs.

v. Flights may not be direct and may include stopovers. This is dependent on the originating airport and flight availability.

vi. If a booking is missed or cancelled by the winner, no alternative tickets will be issued and for the avoidance of doubt, no compensation and/or refund will be provided.

vii. The Prize includes accommodation at a minimum 4-star hotel (based on classification designated by the hotel) based on the winner and the guest sharing one double/twin room, subject to availability.

viii. Any representative of any hotel, airline, or venue used within the travel itinerary has the right to remove or to deny entry to the winner and/or his/her/their guest who engage in a disruptive manner, be intoxicated, be a safety risk, or with intent to annoy, abuse, threaten or harass any other person at any event.

ix. In the event that any portion of the trip or scheduled activities has to be cancelled for any reason whatsoever, in whole or in part, including but not limited to cancellations, postponements, an event of force majeure, an “act of God” (e.g., natural disasters, weather, etc.) or an unforeseeable health event (e.g. pandemic or epidemic), or for any other reason, then Sponsor reserves the right to provide a substitute Prize element of equal or greater value, and no other or additional compensation will be awarded.   

x. The winner will not receive cash or any other form of compensation not otherwise specified within the Official Rules if the actual prize value is less than the ARV estimated in these Official Rules.

xi. Pirelli Hot Laps:

1. All ‘Hot Laps’ passengers must be over 18 years old.

2. All Pirelli Hot Lap passengers must wear a helmet, which they will be provided with.

3. Lap times will be confirmed at least one week from the date of the Hot Laps.

4. All guests must sign their waiver which will be sent via email from Pirelli Hot Laps directly.

5. A mandatory safety briefing will take place before each session which will be run by the F1® Pirelli Hot Laps team. This will cover safety, clothing, helmets, phones/cameras and waivers.

6. There is no requirement for the Hot Laps participant to have a driving license.

7. The exact date and time for the Hot Laps will be at the discretion of Pirelli Hot Laps and the Sponsor. This will be communicated during winner communications. If the winner and/or guest cannot make the date and time provided, they will have to forfeit this element of the Prize and will not receive an alternative time and/or any form of compensation.

xii. The winner must inform the Sponsor of any wheelchair or any similar access needs.

xiii. The Sponsor will pay the cost of the standard room plus related room taxes.

xiv. A valid credit or debit card will be required from winner to check in to the hotel and will be used to guarantee any incidentals such as, but not limited to, in-room calls or services.

xv. The winner is solely responsible for any additional charges incurred at the hotel during their stay, including, without limitation, costs of meals, drinks, additional nights and services together with related taxes.

xvi. The Prize will be arranged by email between the Administrator and the winner. The Sponsor or Administrator will make all reasonable efforts to provide the winner with details of the Prize at the earliest possible opportunity and in any case in good time prior to travel. The Sponsor will have final discretion on all elements and aspects of how the Prize is organised. Once the Prize details including dates and locations are confirmed, this cannot be amended or altered by the winner.

xvii. Once tickets have been issued, they are only valid for the flights/travel, dates and times shown. No alternatives are available. Name changes to the flight once confirmed are not permitted.

xviii. The winner and guest must travel together in all instances and on the same itinerary, on the same dates and time, take the same trip and share the same room in all provided accommodation.

xix. The winner and their guest must abide by and are subject to the airline’s published conditions of carriage and the terms and conditions and policies of all other transport, hotel, venue and event provider.

xx. Lounge passes and upgrades are not permitted. Flights cannot be used in conjunction with the Sponsor’s/any loyalty programme, any other discount, discount coupon(s) or voucher(s), Prize draw(s) or special offer. Frequent flyer points cannot be accrued on the flight tickets or any loyalty programme.

 xxi. Airline seats are subject to availability.

xxii. It will be the winner’s and their guest’s responsibility to obtain at their own cost all relevant insurance (including but not limited to health and travel insurance, insurance for theft, loss and damage to property) which may be required or prudent to be taken.

xxiii. All elements of the Prize package must be taken as part of the same trip.

xxiv. Once tickets have been issued, the Sponsor, will not be liable for any failure to comply with its obligations caused by (but not limited to) weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, illness of a performer or any other circumstances beyond the control of the Sponsor.

xxv. The winner and their guest will require a passport valid for at least 6 months on and following the dates of Prize-related travel; any necessary visas or travel insurance and other required travel documents are the responsibility of the winner and their guest. In the event the winner or their guest are unable to travel due to visa or other personal circumstances, no alternative tickets will be issued, and no compensation or other Prize will be provided.

xxvi. The Prizes are not transferable or exchangeable and cannot be redeemed for monetary value or for any other form of compensation. If for any reason a Prize and/or any element of a Prize is not available, the Sponsor reserves the right, at its sole discretion to substitute that Prize or element of the Prize for another of equal or greater value.

xxvii. No component of the Prize may be transferred or sold unless Sponsor, in its sole discretion, gives prior written permission.

xxviii. The Prize will be forfeited if:

a. The winner is not available to travel on dates specified by Sponsor once the Prize has been booked.

b. The winner has not obtained all of the required travel documents by the date specified by the Sponsor;

c. The winner has any complications which prevent them from entering or leaving their country of residence or the country they are traveling to; or

d. The winner has any medical, legal or any other reason that would prevent the winner from accepting and participating in the Prize.

xxix. It is the responsibility of the winner and any guest to check any travel advisories issued by the relevant government of the destination, to determine whether they wish to accept the risk of travelling to the destination. The Sponsor will not be responsible for any loss or damage suffered by any winner or their guest arising out of their failure to follow any travel advisories issued by the relevant Government. The winner and their guest must comply with and are responsible for obtaining all information regarding any recommended inoculation and obtaining the inoculation(s) and health regulations required by the United Arab Emirates.

xxx. For the avoidance of doubt McLaren Racing Limited are not the Campaign Organiser and therefore assumes no liability in relation to these Official Rules.

xxxi. The Tier 1 winner additionally acknowledges that the Tier 1 Prize involves travel to and participation in activities that may present greater-than-average physical activity and risk. Winner agrees that winner is of satisfactory health to accept and participate in the Tier 1 Prize, and is not suffering from any known medical conditions that may inhibit winner’s participation or prevent winner from accepting and participating in the Prize. The winner, to the extent permitted by applicable law and as applicable, winner’s guest, will be required to release the Released Parties from any liability for any injury, loss, or damage of any kind to persons, including personal injury or death, or property resulting in whole or in part, directly or indirectly, from acceptance, misuse or use of the Tier 1 Prize.

xxxii. The Sponsor may request the winner participates in reasonable promotional activity (such as publicity and photography) surrounding the winning of the Prize, free of charge, and the Sponsor may request the winner consents to the Sponsor and their selected media partners using their name and images in promotional material. The winner is under no obligation to participate and may decline this request. Participation is at the winners’ discretion and is not a condition of Prize acceptance.

 

b. Tier 2, Tier 3, Tier 4 and Tier 5:

i. For all winners, the voucher can be redeemed online at www.optimumnutrition.com or with the assistance of Optimum Nutrition Customer Service.

ii. For winners from Australia, the voucher can also be redeemed at Nutrition Warehouse. 

iii. For winners from Germany, the voucher can also be redeemed at Vitafy.

iv. For winners from Ireland, the voucher can also be redeemed at HP and SuperValu.

v. For winners from Peru, the voucher can also be redeemed at Nutripoint.

 vi. Only one voucher can be used per transaction.

vii. Vouchers expire on 30 April 2026. 

viii. The full value of the voucher must be used in one transaction.  Multiple transactions are not permitted. Any remaining value not used in the first transaction will be forfeited, and the winners will not receive any compensation if their full voucher amount is not used.

c. Tier 2, Tier 3 and Tier 4:

i. The Sponsor is not liable for any Prizes once distributed/dispatched to a winner and the Sponsor will not be responsible for any Prizes not received, broken or lost in transit.

ii. It is the responsibility of the entrant to provide their correct, up-to-date details when entering the Promotion in order for their Prize to be sent via email. The Sponsor cannot be held responsible for winners failing to supply accurate information which affects delivery of their Prize.

iii. Subject to any Non-Excludable Guarantees (defined below), by participating in the Promotion, entrants agree that the Prize is provided on an “as is” basis, and that the Sponsor makes no representations or warranties of any nature with respect to the Prize.

iv. Any pictures depicting the Prizes on any media including press advertisements, posters or TV commercials are indicative only and the actual Prizes may vary from the depictions. The Promotion does not constitute an endorsement or recommendation of the products or services being offered as Prizes.

v. The Sponsor is not liable for third party products and the Prizes are subject to the Prize manufacturer’s terms and conditions.

 

1. Winner Selection: One hundred and sixty-three (163) provisional winners will be randomly selected from all valid entries received during the Promotion Period, beginning with the Tier 1 winner, then Tier 2, Tier 3, Tier 4 and Tier 5 in that order. For your total confidence, the Promotion will be conducted by the Administrator at their offices located at 215 Marsh Road, Pinner, HA5, 5NE, UK on 1 August 2025 at 12:00PM CEST/8:00PM AEST (“Draw Date”).

2. Winner Notification & Return of Required Documentation: Provisional winners will be contacted via the email address provided on entry within seven (7) days of the Draw Date and will be asked to provide evidence of identity (inc. valid passport for travel) and eligibility within seven (7) days of winner notification. CANADIAN WINNERS ONLY: If the provisional winner is a resident of Canada, they will be required to answer a timed four-part maths question before being confirmed a winner. The Tier 1 provisional winner and guest will also be required to complete and return a Declaration of Eligibility, Waiver of Liability and, except where prohibited by applicable law, Publicity Release (collectively, the “Release Forms”) within seven (7) days after the date such Release Forms are sent to the provisional winner, in accordance with the Sponsor’s instructions. In the event that a provisional winner does not respond to the initial contact within seven (7) days or provide the Release Forms, as applicable, within the requested time period, the Sponsor reserves the right to disqualify that provisional winner. If a provisional winner is disqualified, the Sponsor reserves the right to award the Prize to another eligible entrant selected at random (“Reserve Winner”). Reserve Winner(s) may have less time to respond. Once eligibility has been confirmed, a provisional winner will be confirmed as a winner.

3. Unclaimed Prize Draw: If any Prize Draw Prizes are unclaimed twenty-one (21) days after winner notification (as outlined above), an unclaimed Prize Draw will take place from all non-winning valid entries on 5 September 2025 at 12:00PM CEST/8:00PM AEST (“Unclaimed Prize Draw Date”) by Administrator at 215 Marsh Road, London, HA5, 5NE, UK. Provisional winners of any unclaimed Prizes will be notified via the email address provided on entry within seven (7) days of Unclaimed Prize Draw Date and will be subject to the winner notification and return of documentation terms outlined above. Once eligibility has been confirmed, a provisional winner will be confirmed as a winner.

4. Prize Acceptance: Notification to arrange fulfilment of the Prizes will take place within twenty-eight (28) days of acceptance of the Prizes. In the unlikely event that a winner has not received communication to arrange their Prize, the winner must inform the Sponsor by emailing win-with-optimum-nutrition-2025@promowinners.com within a further 28 days. If a winner does not do so, the Sponsor reserves the right to not reissue the Prize or limit its value in its sole discretion.  

5. Tax Obligations:

a. The winners are responsible for all federal, provincial, state and local taxes as well as all costs and expenses associated with Prize acceptance and use not specified herein as being assigned.

b. If a winner is from the USA, they will be required to complete, sign, and return an IRS Form W-9 and furnish their social security number that will be used only for the purpose of reporting the winner’s Prize earnings to the Internal Revenue Service, as required by law. The actual value of the Prize will be reported on IRS form 1099-misc and issued to the winner in 2025. 

c. If a winner is not from the USA, there may be additional or equivalent tax forms required to be issued based on the winner’s country of origin.

d. A winner from any non-USA country may be required to sign and return certain tax documentation. Where applicable, the Sponsor may require the winner to provide additional tax information, as required by law. Unless otherwise specified, all winners will be responsible for any applicable taxes related to the acceptance of any Prize.

e. All winners shall be solely responsible for payment of any and all applicable local taxes for the Prize won.

1. GENERAL CONDITIONS:  The Sponsor seeks to run a fair and secure Promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Official Rules, your entries will be disqualified. Any Prize awarded may be void and recoverable, and the Sponsor reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, subject to any directions by a regulatory authority, the Sponsor reserves the right at any point to:

a. Verify the eligibility of entrants and/or provisional winners by requesting such information it considers reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.

b. Disqualify entries that are not made directly by the individual entering the Promotion.

c. Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.

d. Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by bots, macros or other automated means.

e. Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.

f. Disqualify entrants who tamper with the entry process.

g. Disqualify entries which, in some other way, do not meet the requirements of these Official Rules.

h. Cancel, modify or suspend the Promotion if it cannot be run as planned, for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.

1. Moderation: The Promoter reserves the right to reject entries which, in the reasonable opinion of the Promoter:

a. are in breach of the Terms & Conditions;

b. contain any content that is offensive, harmful, objectionable or which is otherwise unsuitable for publication including with respect to race, religion, origin or gender, or which could reflect negatively upon the name, reputation or goodwill of the Promoter or any brand partner;

c. contains or refers to any unauthorised third-party brand or reference any third-party names, logos and/or trademarks;

d.               contains any content which has been created by an AI tool or which has been influenced by AI; or

e.               promotes any political agenda.

 

1. No Waiver: Failure of the Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision and such provision shall remain in full force and effect. In the event of any conflict with any Promotion details contained in these Official Rules and the Promotion details contained in any Promotion materials (including, but not limited to, point of sale, television and print advertising, or any other Promotion media), the details of the Promotion as set forth in these Official Rules shall prevail.

2. LIMITATION OF LIABILITY AND RELEASE: By entering the Promotion, each entrant agrees: (i) to be bound by these Official Rules, (ii) to waive any rights to claim ambiguity with respect to these Official Rules; (iii) to the extent permitted by law, to waive all of their rights to bring any claim, action or proceeding against any of the Released Parties in connection with the Promotion; and (iv) to the extent permitted by law, to forever and irrevocably agree to release and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable attorneys’ fees) that may arise in connection with: (a) the Promotion, including, but not limited to, any Promotion-related activity or element thereof, participation or inability to participate in the Promotion; (b) the violation of any third-party privacy, personal, publicity or proprietary rights; (c) acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or wilful misconduct in connection with the use of a prize (or any component thereof); (d) any change in the Promotion or prizing (or any components thereof); (e) human error; (f) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties; (g) lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof); or (h) the negligence or wilful misconduct by entrant. Nothing in these Official Rules limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these Official Rules would contravene any statute or cause any part of these Official Rules to be void.

3. By participating in this Promotion, entrants and winners agree that the Sponsor, Fédération Internationale de l’Automobile, Formula One and each of their respective affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, fulfilment and marketing agencies, website providers and each of their respective officers, directors, stockholders, employees, representatives, designees and agents (the “Released Parties”) are, where not excluded by law, not responsible for:

a. Lost, late, incomplete, stolen, misdirected, or undeliverable e-mail notifications or postal mail;

b. any computer, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability;

c. garbled, corrupt or jumbled transmissions, service provider/ Internet/ website/ UseNet accessibility, availability or traffic congestion;

d. any technical, mechanical, printing or typographical or other error;

e. the incorrect or inaccurate capture of registration information or the failure to capture, or loss of, any such information;

f. any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Promotion;

g. any property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in the Promotion, or possession, acceptance and/or use or misuse of prize or participation in any Promotion-related activity and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action;

h. any and all federal, state and local taxes;

i. entries that are late, forged, lost, misplaced, misdirected, tampered with, incomplete, deleted, damaged, or otherwise not in compliance with these Official Rules; and

j. for any loss (including, without limitation, indirect, special or consequential loss, punitive or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using a prize, except for any liability which cannot be excluded by law.

1. If, for any reason, beyond the reasonable control of Sponsor, the Promotion cannot be run as planned, or the integrity and or feasibility of the Promotion is severely undermined by any event beyond the control of the Sponsor, then subject to any directions of a regulatory authority the Sponsor will not be liable for any failure to comply with their obligations or any delay in performing their obligations within these Official Rules if an act, omission, event or circumstance occurs caused by (but not limited to) global or regional health crises, weather conditions, fire, flood, strike, hurricane, earthquake, explosion, industrial dispute, war, terrorist activity, any federal, state, provincial or local government law, order, or regulation, order of any court or jurisdiction, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God or any other circumstances beyond the reasonable control of the Sponsor (each a “Force Majeure” event or occurrence).

THIS PROMOTION AND ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. Nothing in these Official Rules limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these Official Rules would contravene any statute or cause any part of these Official Rules to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Sponsor excludes from these Official Rules all conditions, warranties and terms implied by statute, general law or custom.

PUBLICITY RELEASE: Where otherwise not prohibited by law, participation in Promotion and acceptance of a prize constitutes each winner’s permission for Sponsor to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information, and/or any statements made by each winner regarding the Promotion or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law.

2. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

The data controller is the Sponsor.  Any personal data relating to the entrants will be used solely in accordance with applicable law for the purpose of the performance of the Promotion.  Where applicable, the processing of the personal data, by the Sponsor, in connection with the Promotion, is based on article 6 (1) b) of the GDPR (processing is necessary for the performance of a contract to which the data subject is party).  In particular, the entrants’ personal data will be used to (a) verify the eligibility of the provisional winners, (b) contact the provisional winners, (c) allocate the Prizes. The Sponsor will be required to share the entrants’ personal data with Administrator in order to administer the Promotion. Where applicable, the entrants have a right to (i) access, correct, update, enrich their personal data, (ii) have their personal data locked or deleted from the data controller’s database, (iii) set the consequences of their death on their personal data and (iv) to oppose the data processing. 1. SEVERABILITY: If any part/s of these Official Rules are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.

Disputes; Governing Law; Mandatory Binding Arbitration.  Where legally permissible, and except in the case of legal actions brought by Sponsor to obtain injunctive or other equitable relief of whatsoever kind, all of which may be brought in any court or other tribunal of competent jurisdiction, ANY CONTROVERSY, CLAIM, DISPUTE OR OTHER LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THESE OFFICIAL RULES OR THEIR SUBJECT MATTER, WHETHER BASED IN CONTRACT, TORT, STATUTE, FRAUD, MISREPRESENTATION OR ANY OTHER LEGAL THEORY, SHALL BE SUBMITTED TO THE OFFICE OF THE AMERICAN ARBITRATION ASSOCIATION LOCATED IN, OR CLOSEST TO, DUPAGE COUNTY, ILLINOIS, UNITED STATES, AND WILL BE SETTLED BY ARBITRATION TO OCCUR IN DUPAGE COUNTY, ILLINOIS, UNITED STATES, SAID ARBITRATION TO BE ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION IN ACCORDANCE WITH ITS COMMERCIAL ARBITRATION RULES (AVAILABLE AT https://adr.org/sites/default/files/ Commercial%20Rules.pdf) , IN EFFECT AT THE TIME OF THE ARBITRATION, THE LAWS OF THE STATE OF ILLINOIS GOVERNING SUCH ARBITRATIONS, AND IN ACCORDANCE WITH THESE OFFICIAL RULES. SUCH ARBITRATION MUST BE FILED WITHIN TWELVE (12) MONTHS OF THE FIRST ACCRUAL OF THE CAUSE OF ACTION, AND THE PARTIES AGREE THAT THE STATUTE OF LIMITATIONS FOR ANY CAUSE OF ACTION BROUGHT PURSUANT TO, IN CONNECTION WITH, OR RELATING TO A DISPUTE WILL BE TWELVE (12) MONTHS FROM THE FIRST ACCRUAL OF THE CAUSE OF ACTION, NOTWITHSTANDING ANY STATUTE TO THE CONTRARY. ANY ARBITRATION UNDER THESE OFFICIAL RULES WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED.

The arbitration will be heard and decided no later than seven (7) months after the notice of arbitration is filed with the American Arbitration Association by one arbitrator. The arbitrator will hear and determine any preliminary issue of law asserted by a party to be dispositive of any claim, in whole or in part, in the manner of a court hearing a motion to dismiss for failure to state a claim or for summary judgment, pursuant to such terms and procedures as the arbitrator deems appropriate. No witness or party may be required to waive any privilege recognized under Illinois law. The hearing will not last longer than four (4) days unless all parties agree otherwise, with time to be divided equally between you and Sponsor. The arbitrator will be an attorney, licensed to practice law in the State of Illinois for no less than ten (10) years, with no less than five (5) years’ experience as an arbitrator. The parties and the arbitrator will treat all aspects of the arbitration proceedings, including, without limitation, discovery, testimony and other evidence, briefs, and the award, as strictly confidential and not subject to disclosure to any third party or entity, other than to the parties, the arbitrator, and the American Arbitration Association. The arbitrator must give full effect to the applicable law and to all of these Official Rules, and is specifically divested of any power to add to, subtract from, modify or alter any of the terms or conditions of these Official Rules, or to render decisions in derogation thereof. The arbitrator will have no authority to award punitive or other damages not measured by the prevailing party’s actual direct damages, except as may be required by statute.

THE PARTIES UNDERSTAND THAT THEY ARE WAIVING THEIR RIGHTS TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. YOU AND COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Sponsor agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration provision shall be null and void. The arbitrator will issue written findings of fact and conclusions of law, the decisions of the arbitrator will be binding and conclusive upon all parties involved, and judgment upon any decision of the arbitrator may be entered in any federal or state courts with jurisdiction. You are solely responsible for your interactions with other entrants of this Promotion. Sponsor reserves the right, but has no obligation, to monitor disputes between you and other entrants of this Promotion.

For all entrants, regardless of jurisdiction of residence and applicability of arbitration: THE PARTIES UNDERSTAND THAT THEY ARE WAIVING THEIR RIGHTS TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. YOU AND COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. 

1. FOR USA RESIDENTS: THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF ILLINOIS, UNITED STATES, WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgement on an arbitration award in connection with these Official Rules and/or the Promotion, or for any reason, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in in the State of Illinois, United States. The parties agree not to raise the defense of forum non conveniens.  Except where prohibited, such claims shall be resolved individually, without resort to any form of class action. Any and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

For all other residents: Despite the foregoing, these Official Rules shall be governed by the law of the relevant country for each entrant, and entrants submit to the exclusive jurisdiction of the courts of the relevant country they reside in.

The Fédération Internationale de l’Automobile, Formula One and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, members, representatives, and employees (collectively, the “Entities”) will have no liability or responsibility for any claim arising in connection with participation in this Promotion or any prize awarded and have not offered or sponsored this Promotion in any way.
